How the Criminal Justice System Works

What to Expect:

Phase #1: Arrest and Arraignment

You're probably here because you've been arrested and possibly arraigned on a criminal charge. This is the initial step in a criminal proceeding.
It is essential to speak with an attorney as soon as possible to ensure the best outcome in your case.

Phase #2: Potential Disposition/Plea Bargaining and Settlement

After the arrest and arraignment, we will begin to plea bargain your case. This is the stage where the attorney is essential in getting the best possible outcome for you.
Not all cases resolve in a plea arrangement. In some circumstances the case will proceed to Motions, Hearings and Trials.

Phase #3: Motions, Hearings, and/or Trial

Finally, if your case does not resolve as part of a plea agreement it could proceed to the Motion, Hearing and/or Trial stage.
Each case is determined on a case by case basis. Not all cases will require a trial.

FREQUENTLY ASKED QUESTIONS

  • How Does Bail Work?

Bail is considered on a case-by-case basis.  The Court will consider numerous factors when considering whether to set bail.  This includes the defendant's criminal history, his/her history regarding failures to appear, whether the person has local ties to the community (including family ties, a local address, and  substantial employment).  The Judge can also consider the strength or weakness of the case when setting bail.

  • What if I'm on Probation?

We will contact your probation officer and work with their office throughout the proceedings. Oftentimes we can find a global resolution which satisfies all charges.

  • Was it Legal that my Car or Home was Searched?

The Federal and State Constitution protect citizens from unlawful searches and seizures. This is a complex area of law and involves applying Federal and New York State case law to the facts of your case. When appropriate, we seek to exclude any illegally obtained evidence that the prosecution intends to use in its case.

  • What is a Preliminary Hearing?

A preliminary hearing is required by CPL 180.80 when a felony complaint is filed against you.  This requires the court to hold a hearing within 120 hours of being confined to custody. (144 hours if within a weekend or holiday).

If the court has not held a hearing within that time, or served notification that the Grand Jury has indicted you on at least one felony charge, then they must release you on your own recognizance.

  • Do You Take Pro Bono Cases?

We contribute to a variety of charitable causes. Pro Bono representation is generally provided to those who are in need of representation who truly have no ability to retain private counsel.

  • How Long Will it Take to Resolve my Case?

All cases are different.  While some cases may resolve quickly in a few weeks, some may take a bit longer and last months.  It is important to find an attorney who can move your case along and get it resolved as soon as possible.

  • What Type of Attorneys Should I Avoid?

We recommend that you feel comfortable that the attorney you choose has your best interest in mind and understands all of the nuances of criminal law.

  • Are You More Expensive Than Other Attorneys?

Our fees are commensurate with other attorneys in our area.   Every case is different in terms of the time and resources needed to resolve it.  If you become a client, we can guarantee that you will benefit from the expertise of our years and years of work in the field of criminal law.

  • What Should I Ask Before Hiring an Attorney?

It is important to ensure that your attorney understands all of the ramifications of a criminal arrest and potential conviction.   We understand how this situation can negatively impact your future (including child support, custody, and employment).

  • Can my Case be Dismissed with the Passage of Time?
