Phase #1: Arrest and Arraignment
You're probably here because you've been arrested and possibly arraigned on a criminal charge. This is the initial step in a criminal proceeding.

Phase #2: Potential Disposition/Plea Bargaining and Settlement
After the arrest and arraignment, we will begin to plea bargain your case. This is the stage where the attorney is essential in getting the best possible outcome for you.

Phase #3: Motions, Hearings, and/or Trial

Bail is considered on a case-by-case basis. The Court will consider numerous factors when considering whether to set bail. This includes the defendant's criminal history, his/her history regarding failures to appear, whether the person has local ties to the community (including family ties, a local address, and substantial employment). The Judge can also consider the strength or weakness of the case when setting bail.
We will contact your probation officer and work with their office throughout the proceedings. Oftentimes we can find a global resolution which satisfies all charges.
The Federal and State Constitution protect citizens from unlawful searches and seizures. This is a complex area of law and involves applying Federal and New York State case law to the facts of your case. When appropriate, we seek to exclude any illegally obtained evidence that the prosecution intends to use in its case.
A preliminary hearing is required by CPL 180.80 when a felony complaint is filed against you. This requires the court to hold a hearing within 120 hours of being confined to custody. (144 hours if within a weekend or holiday).
If the court has not held a hearing within that time, or served notification that the Grand Jury has indicted you on at least one felony charge, then they must release you on your own recognizance.
