Why phone records may not answer the ticket
Many drivers assume that if their phone records do not show an active call, the ticket should be dismissed. That can be a dangerous assumption. A cell phone allegation may focus on use of the device, not just a live telephone conversation.
If the officer says they saw you holding or interacting with the phone, the absence of a call record may not answer the claim. The better review starts with the ticket, the supporting deposition and the exact conduct alleged.
